Field Sobriety Test Should Not Be Used In Every Traffic Stop

Police officers receive rigorous training on when it is appropriate to administer certain types of field sobriety tests. For instance, offices are instructed not to administer the Horizontal Gaze Nystagmus (HGN) – a test designed to identify an involuntary jerking of the eyes that can be cause by ingesting alcohol – if a person has brain damage, a glass eye, certain types of visual impairment in an eye, etc.  In addition, officers will not administer field sobriety tests if the individual has physical limitations, e.g. leg & back problems, lower back injury, and other preexisting conditions/impairment.

If you were stopped for suspicion of DUI/DWI and feel that certain tests were administered unfairly, you should get a case evaluation by an experienced criminal attorney. Legal and administrative defenses for DUIs are time sensitive and need to be asserted at the earliest possible date.
